Naturism suffered a setback when, despite appeals by naturists that nude is not lewd, Illinois HB 5874 was signed into law. As opposed to being charged with indecent exposure, this new law allows mere skinny-dippers and nude sunbathers to be charged as sex offenders regardless of how lacking of lewdness. However, this was outweighed by numerous victories for naturists in other states. Paradise Gardens resort has been a part of Cincinnati, OH for over three decades. Despite this, only recently did a township make multiple attempts to shut down the club. However, all four judges in two levels of the Ohio court system ruled in favor of Paradise Gardens with the final victorious decision in the long proceedings coming in August 2002. In addition, AANR and NAC helped naturists turn back several overbroad anti-nudity bills in Ohio. Ohio House Bill 469 would have, among other things, allowed townships to ban ANY nudity, endangering family nudist clubs instead of just controlling adult entertainment establishments. Other suspect Ohio bills were HB 531 and SB 251. In April 2002, naturists were urgently asked to persuade key Ohio lawmakers against HB 469. This call was headed in gratifying numbers. In May, naturist organizations successfully weighed in at a bill hearing. Finally, HB 469 was watered down late in the year so that it no longer concerns naturists. In addition, HB 531 and SB 251 never gained any momentum. Further good news is that overbroad anti-nudity bills in other states either died or were passed in forms more harmless to naturism. Kentucky HB 385 is dead legislation that, despite a few exclusions for some nudity, could have hurt naturists. Except for SB 104, a series of West Virginia bills died that would have regulated adult entertainment businesses but could have negatively effected naturism.
